Detention reviews in Canada are part of the Immigration and Refugee Protection Act (IRPA), which allows detained people to challenge the legality of their detention. The process is overseen by the Immigration and Refugee Board of Canada (IRB), specifically, the Immigration Division (ID). Detention reviews seek to ensure that detention is proportionate, necessary, and consistent with the Canadian Charter of Rights and Freedoms.

An immigration officer may detain a person if they believe it is necessary for immigration purposes or if the person is deemed a flight risk or a threat to public safety. The detained person will then be issued a detention order outlining the reasons for their detention.

If an individual has been detained, he can invoke his right for a detention review to ensure the legality and proper justification for the detention. The process involves the request for a detention review, the preparation of evidence and submissions, and the eventual hearing.
